The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307 of the Indian Penal Code.

The petitioner allegedly assaulted with Dab (a sharp cutting weapon) causing injury at the head of the informant. The Doctor has found simple head injury. Submission is that witnesses have stated before the Police that informant was himself in inebriated condition and he might have sustained injury by fall. Even the Investigating Officer has recorded in para 11 of the case diary that on medical examination the informant was found drunken.

Considering the aforesaid fact, let the petitioner,

Patna High Court Cr.Misc. No.48009 of 2018(3) dt.29-11-2018 2/2 above named, who has got no criminal antecedent, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Bypass Police Station Case No.21 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
