JUSTICE ASHUTOSH KUMAR ORAL ORDER 26-08-2021 Heard Mr. Ravish Mishra, learned counsel for the petitioner and Mr. Manish Chandra Gandhi, for the informant. The State is represented by Mr. Lakshmi Kant Sharma, learned APP.

The petitioner seeks bail in anticipation of his arrest in connection with Hajipur Town P.S. Case No. 803 of 2019 dated 06.09.2019 instituted for the offences under Section 498(A) of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act. Learned counsel for the the petitioner has, at

No.3644 of 2021(2) dt.26-08-2021 2/3 the outset, submitted that he is ready to keep the opposite party no. 2 as his legally wedded wife and accord to her every benefit to which she is entitled. Mr. Gandhi, learned Advocate for the opposite party no. 2 has also stated that opposite party no. 2 also is interested in resumption of matrimonial life but the petitioner always dumps her at Sultanpur and does not keep her at his place of posting.

Be that as it may, both the parties are agreeable for negotiations between them for an amicable solution to their matrimonial dispute.

Under the aforesaid circumstances, this Court directs that in the event of the surrender of the petitioner within a period of eight weeks from today, he shall be granted provisional bail and simultaneously notice shall be issued to the informant. On the appearance of the informant, the court will explore the possibilities of settlement and if the issues between the spouses are settled, the provisional bail of the petitioner

Patna High Court CR. MISC. No.3644 of 2021(2) dt.26-08-2021 3/3 shall be confirmed. The provisional bail of the petitioner shall also be confirmed in the event of the informant showing an unreasonable attitude during the deliberations. If the conduct of the petitioner is not good, that should also be taken into account before confirming the provisional bail of the petitioner. The petition stands disposed of.
