2. The petitioner is in custody in connection with Sherghati P.S Case No. 858 of 2022, for the offence under Sections 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

3. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 24.05.2023. He further submits that in the instant case total 129.600 litres of country made liquor and 14.940 litres of foreign wine was seized.

4. There is recovery of 129.600 litres of country made liquor and 14.940 litres of foreign wine from the alleged tempu which creates doubt upon the petitioner.

5. Considering the fact that the petitioner has got no criminal antecedent and period of custody, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Addl. Sessions Judgecum-Exclusive Special Excise Judge, Court No. 2, Gaya in connection with Sherghati P.S Case No. 858 of 2022. (Sandeep Kumar, J) Harsh/ U T
