2. This matter has been listed under the heading "To Be Mentioned" at the instance of the office.

3. The petitioner has preferred this application for grant of regular bail in connection with Mansi P.S. Case No. 290 of 2024 dated 04.12.2024 registered for the offences punishable under Sections 190, 191(2), 191(3), 115(2), 126(2), 109, 303(2), 352 and 351(2) of B.N.S. and 27 of Arms Act.

4. As per the prosecution case, it is alleged that when the informant and his cousin, Komal Rai were ploughing the field, in the meantime, the petitioner and the co-accused persons armed with rifle and iron rod came and started abusing and

On being opposed by the informant's cousin, Komal Rai, the co-accused Chhotu Rai abused him and assaulted the informant with iron rod, the co-accused Santosh Rai fired on the head of the informant and the co-accused Pikesh Rai assaulted the informant's cousin with an iron rod, on halla, some other persons came for the rescue, they were also assaulted with iron rod. It is further alleged the co-accused Chhotu Rai also took away golden chain of the informant and threatened him to kill.

5. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is land dispute between the parties and both the parties are gotiyas. There is no specific allegation of assault against the petitioner rather the allegation against the petitioner is general and omnibus in nature. As per the injury report of the injured, the injuries are simple in nature caused by hard and blunt substance. It is further submitted that there is case and counter-case between the parties. The petitioner has no concern with the alleged occurrence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 25.04.2025.

6. Learned A.P.P. for the State has opposed the bail

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Khagaria in connection with Mansi P.S. Case No. 290 of 2024.

8. The application stands allowed.
