====================================================== CORAM: HONOURABLE MR. JUSTICE PARTHA SARTHY ORAL ORDER 24-06-2021 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State through video conferencing.
The petitioners have filed the instant application for grant of regular bail in connection with Hathua P.S. Case no. 86 of 2020 registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016 and sections 25(1-B)(a), 26 and 35 of the Arms Act.
As per allegation in the FIR, in course of checking, 421 litres of IMFL, a country made pistol and a life cartridge was recovered from the vehicle in which both the petitioners were present.
Patna High Court CR. MISC. No.716 of 2021(3) dt.24-06-2021 2/2 It is submitted by learned counsel for the petitioners that the allegations as levelled in the FIR are false and concocted. No incriminating article has been recovered from their possession or from their vehicle. The petitioners have no criminal antecedent and are in custody since 30.9.2020. The application for bail is opposed by learned Additional Public Prosecutor for the State.
Having heard learned counsel for the parties and taking into consideration the period in custody and investigation in the case having concluded, the petitioners are directed to be enlarged on bail in connection with Hathua P.S. Case no. 86 of 2020 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge -II -cum-Special Judge, Excise, Gopalganj.
