Petitioner seeks bail in a case registered for the offence punishable under Sections 413 and 414 of the Indian Penal Code.

Informant in his written complaint has alleged that when he was on patrolling duty, he received secret information that accused Sanjay Chaudhary had brought stolen article from somewhere which is being concealed in a Mill, and thereafter when he reached the place, saw that accused petitioner Sanjay Chaudhary was unloading articles from pick-up van and keeping the same in house. Upon seeing the police party, accused petitioner fled away. Thereafter mother of accused-petitioner disclosed that house belongs to her and Mill runs in it. She further disclosed that the pick up van belongs to her son Sanjay

Learned counsel for the petitioner submits that he is innocent and has been falsely implicated in this case on mere suspicion only. No incriminating material has been recovered from the conscious possession of petitioner. The Pick up Van bearing Registration No. BR26E3853 is not the stolen one and the same belongs to the petitioner. Petitioner is in custody since 01.05.2021.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Amas P.S. Case No. 89 of 2021, with following conditions:-

(1) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below.

(2) The petitioner shall fully cooperate with the investigation / trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (S. Kumar, J) ranjan/- U
