The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 307 and 34 of the Indian Penal Code and Section 27 of Arms Act. Allegation against the petitioner is that he opened fire upon the informant but did not hit him and he narrowly escaped. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence due to his criminal antecedents. It is further submitted from para-12 of this petition that the aunt of this petitioner namely, Lovely Devi lodged Nawkothi P.S. Case No. 102/21 against the family member of present informant and other in which husband of the
Patna High Court CR. MISC. No.46028 of 2022(8) dt.10-08-2023 2/2 Lovely Devi was murdered and this case has been lodged only to save neck from that case. No one was injured from the firing which had been fired by the petitioner. Moreover, the petitioner is languishing in judicial custody since 30.10.2021. Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Nawkothi P.S. Case No. 87 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Begusarai.
