2. The petitioner is in custody since 27.04.2023 in connection with Bihariganj P.S. Case No. 212 of 2022 registered for the offence punishable under Sections 323/341/379/307/ 504/506/34 of the Indian Penal Code.

3. The petitioner is said to have assaulted the victim on his head.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. It is further submitted that the petitioner and the informant are next door neighbours. There is case and counter case between the parties. The petitioner has no criminal antecedent.

5. However, learned A.P.P. appearing on behalf of the

Patna High Court CR. MISC. No.46639 of 2023(2) dt.28-07-2023 2/2 State vehemently opposed the bail application.

6. In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Udakishunganj, Madhepura in connection with Bihariganj P.S. Case No. 212 of 2022.
