The Petitioners apprehend their arrest in Complaint Case No.102 of 2016 instituted for the offence under Section(s) 420, 467, 468/34 Indian Penal Code.

It is alleged in the written report that the petitioners got sale deed executed by imposter Sonia Kunwar, wife of Lalan Pasi in place of Sonwa Devi, wife of late Jagdish Pasi. Counsel for the petitioner has submitted that he got sale deed executed from Soniya Kunwar, who is wife of late Jagdish Ram, daughter-in-law of Khatiyani Raiyat. She is still

Patna High Court Cr.Misc. No.28320 of 2017 (3) dt.18-07-2017 2/3 alive and Xerox copy of her Aadhar Card, Voter list, bank account etc. have also been filed along with Supplementary Affidavit showing that Soniya Kunwar (vendor of the petitioner) is wife of Jagdish Ram.

It is further submitted that even if the allegation is taken at its face value, it is a matter of pure civil dispute. In the facts and circumstances of the case, prayer of the petitioners for grant of anticipatory bail is allowed. In the event of surrender/arrest of the petitioners, named above, within six weeks from today in connection with Complaint Case No.102 of 2016, they shall be released on anticipatory bail on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Bikramganj, Rohtas, subject to the conditions as laid down under Section 438(2) Cr. P. C.
