Petitioner apprehends his arrest in connection with Nanpur P.S.Case No. 160 of 2018 registered for the offence punishable under Section 304 of the Indian Penal Code. Allegation against the petitioner is that he was running electric wire through his field in which deceased was contacted and died.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and petitioner is 70 years old.

Heard learned APP and learned counsel for the informant. They have opposed the prayer for anticipatory bail. Having heard both sides and in the facts and circumstances, let the petitioner, named above, in the event of his

No.45661 of 2018 (3) dt.29-08-2018 2/2 arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Pupri, Sitamarhi, in connection with Nanpur P.S.Case No. 160 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
