The petitioner apprehends his arrest in connection with Complaint P.S. Case no. 390 (C) of 2018, registered under Section 406 and 420/34 of the Indian Penal Code and Section 138 of the N.I. Act.
Learned counsel for the petitioner and O.P. No.2 submits that on the joint prayer of the parties, the matter was referred to Mediation Centre, Patna High Court, Patna for settlement of dispute between the petitioner and O.P. No.2 vide order dated 11.12.2018, where the petitioner and O.P. No.2 has settled the dispute to the effect that petitioner will pay Rs.
Patna High Court CR. MISC. No.45886 of 2018(4) dt.22-04-2019 2/2 Five Lakh to the O.P. No.2 within six months. The dispute between the parties has been resolved through the process of mediation and petitioner and O.P. No.2 entered into an agreement, which is the part of Mediator's report dated 12.04.2019.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabua in connection with Complaint Case No. 390© of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C (Rajendra Kumar Mishra, J) manish/- U T
