The petitioner seeks Anticipatory bail in connection with Complaint Case No. 1482 of 2017 registered under Sections 498(A), 376, 511, 420/34 of the Indian Penal Code. Petitioner is the brother-in-law of the victim (complainant) and there is allegation of attempt to commit rape against the petitioner and also for demanding of Rs. 2 lakhs. It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this case due to matrimonial dispute of husband and wife. Patna High Court Cr.Misc. No.47746 of 2018(3) dt.13-09-2018 2/2 submitted that from the same impugned order her husband Md. Mahmood Alam has been granted anticipatory bail. Petitioner has no criminal antecedent.
Considering the facts and circumstances of the case, prayer of Anticipatory bail is allowed and petitioner named above in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- VI, Katihar, in connection with Complaint Case No. 1482 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
