The petitioner seeks bail in connection with Baisi P.S. Case No. 248 of 2020 for the offence under Sections 272 and 273 of the Indian Penal Code and Sections 30(a), 41 and 47 of the Bihar Prohibition and Excise Act, 2016. Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. Nothing has been recovered from the conscious possession of the petitioner rather the alleged recovery has been made from truck and the petitioner has no concern with the alleged recovery. Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing his personal bond to the satisfaction of learned Special Judge (Excise), Purnea in connection with Special Excise Case No. 423 of 2020 arising out of Baisi P.S. Case No. 248 of 2020.
