The petitioner apprehends his arrest in Barachatti P.S. Case No. 352/2016, registered for the offences punishable under Sections 120B, 121 and 122 of the Indian Penal Code and sections 4 and 5 of the Explosive Substances Act and section 17 of the C.L.A. Act.
On the basis of confidential information, the police intercepted a Van containing explosives. Anamul Haq was apprehended and he disclosed the name of the petitioner and others.
Learned counsel for the petitioner submits that the petitioner is licensee of the explosive substances shop which is

It is further submitted that wife of the petitioner filed petition before the Superintendent of Police, Gaya and the petitioner filed petition before the D.I.G. Gaya for impartial investigation of the case, but from perusal of the records, I find that the petitioner is of course licensee of the explosive substances shop, but he sold the explosives to extremists who were carrying the same for destructive works.
Considering the facts aforesaid and the fact that petitioner is not authorized to sell the explosives to unauthorized persons, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J.) Vinita/- U T
