The petitioner seeks bail in Barhara (Raghubanshnagar) P.S. Case No. 62/2019, instituted for offence under Section(s) 302, 120(B)/34 of the Indian Penal Code read with Section 27 of Arms Act.
Learned counsel for petitioner has submitted that there is no direct allegation against this petitioner of causing firearm injury to the elder brother of informant in the First Information Report. There is allegation against seven named accused persons and 10-15 unknown persons of causing death of elder brother of informant by firearm. In the later part of F.I.R., name of this petitioner has come that accused persons were taking water in the house of petitioner.
Patna High Court CR. MISC. No.43389 of 2019(3) dt.30-08-2019 2/2 Petitioner is in custody since 10.05.2019.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea, in connection with Barhara (Raghubanshnagar) P.S. Case No. 62/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner.
