The petitioner is apprehending his arrest in connection with Sono/Charkapathar P.S. Case No. 135 of 2021 for the offence registered under Sections 147, 148, 149, 341, 323, 307, 504 and 506 of the Indian Penal Code.

As per the prosecution story, the informant was sitting at his door when the accused persons variously armed came and started assaulting. The specific allegation is against the petitioner is of giving 'farsa' blow on the head causing injury. Learned counsel for the petitioner submits that the doctor has found hair line injury on the head. There is a case and counter case and as such, he deserves anticipatory bail.

Patna High Court CR. MISC. No.46011 of 2022(2) dt.02-01-2023 2/2 Learned APP for the State, on the other hand, opposed the prayer for anticipatory bail stating that there is specific allegation against him.

Taking into account the fact that allegation is of assault on the head of the informant, the doctors have found the injuries to be grievous in nature and further the petitioner has criminal antecedent, this Court is not inclined to grant him privilege of anticipatory bail, which is accordingly rejected.
