The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 323, 324, 307, 341, 354, 379, 448, 504, 506/34 of the Indian Penal Code.
There is case and counter case. The allegation against the petitioners is of commission of injury at the head of the informant and his wife.
Submission is that the Doctor has found simple injury. There is no allegation of repetition of blow. Considering the fact that petitioners had knowledge that their act might cause death, hence, I am not inclined to

Hence, prayer is refused in connection with Angarghat Police Station Case No.26 of 2018 pending in the court of learned 2nd Additional Chief Judicial Magistrate, Dalsingsarai. In the event of their surrender before the court below within three weeks their prayer for regular bail shall be considered without being prejudiced by this order and considering the fact that there is case and counter case.
