The petitioner is apprehending his arrest in a case registered under Sections 341, 323, 307, 379, 504, 506/34 of the Indian Penal Code.

The prosecution case, in brief, is that when the informant was closing his shop at night, the accused persons arrived there and assaulted him. The petitioner is alleged to have tied the rope in his neck.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in this case due to village

Patna High Court Cr.Misc. No.48756 of 2018 (3) dt.05-10-2018 politics.

On behalf of the State, it is submitted that the petitioner and other co-accused namely Putul Sah have assaulted the informant. Against rest of the accused, there is general and omnibus allegation. There are altogether three injuries on the body of the informant. One injury is said to be grievous in nature. Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail of the petitioner in connection with Barsoi P.S. Case No. 167 of 2018 is rejected. If the petitioner surrenders in the court below, the same shall be considered on its own merit without being prejudiced by this order.
