====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 31-10-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks regular bail in connection with S.T. No. 134 of 2024, C.I.S. No. 46 of 2024 arising out of Bibhutipur P.S. Case No. 386 of 2023, registered for the offence punishable under Sections 413 and 414 of the Indian Penal Code and Sections 25(1-b)a and 26 of the Arms Act.

3. Earlier, the prayer for bail of the petitioner was rejected vide order dated 26.10.2024 in Cr. Misc. No. 56242 of 2024.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is in custody since 30.09.2023 and the trial is still pending.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Considering the delay in trial and the period of custody, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Additional Sessions Judge 2nd, Rosera, Samastipur/ concerned Court below in connection with S.T. No. 134 of 2024, CIS No. 46 of 2024 arising out of Bibhutipur P.S. Case No. 386 of 2023, subject to the following condition:

8. As a condition of this order, the petitioner, after being released on bail, is directed to co-operate in the trial either by appearing personally or through his counsel on each and every date fixed by the trial court. Non-compliance of this condition shall result in cancellation of the bail bonds of the petitioner.

9. The petitioner is directed to mark his attendance in Bibhutipur Police Station on every Sunday of each month. Failure to do so, will result in cancellation of bail bonds of the petitioner.
