1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 316(5) and 3(5) of the B.N.S., 2023.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and petitioner

No.45453 of 2026(2) dt.15-07-2026 2/3 no.1, 2 and 3 are women and the informant alleges that the last date for depositing CMR against the total procure paddy under the Kharif season of 2023-24 was 31.10.2024, however Tikuliya PACS under Motihari block did not supply 100 percent CMR equivalent to the purchased paddy, further despite sufficient time being given to deposit the cash, the committee has not yet deposited the remaining CMR equivalent amount of paddy, amounting to Rs.32, 58, 762.52/-.
4. Learned counsel for the petitioners submits that petitioners being members of the PACS have been falsely implicated in the instant case by the informant. It is next submitted that President of the PACS was taken in custody and was released on bail by an order dated 01.04.2026 in B.P. No.587 of 2026 passed by the learned Sessions Judge, East Champaran, Motihari. It is next submitted that the President of the PACS deposited an amount of Rs.16 lacs and also assured the learned District Court of depositing the remaining amount within a period of six months. It is thus submitted that it was President of the PACS, who committed the occurrence, thus accepted to return the amount.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned trial court where the case is pending/successor court in connection with Muffasil P.S. Case No.46 of 2026, subject to the conditions as laid down under Section 482(2) of the B.N.S.S.
