The petitioner apprehends his arrest in Bodh Gaya (Cherki) P.S. Case No. 341/2016, registered for the offences punishable under Sections 420, 409 of the Indian Penal Code. The petitioner while he was posted in Primary School Pramod Nagar from 11.07.2009 to 13.12.2012, the petitioner withdrew Rs. 9,25,000/- for construction of school building, but he did not complete the construction of school building. Rs. 96,000/- still lying due against the petitioner.

Learned counsel for the petitioner submits that petitioner has already completed the school building and the petitioner has annexed the photo-graphs of the school building. It appears that the F.I.R. was lodged on 01.09.2016

Patna High Court Cr.Misc. No.29510 of 2017 (3) dt.21-08-2017 2/2 on the basis of letter of Block Education Officer, Bodhgaya. The petitioner was transferred from the school in the year 2012, but even after four years till the institution of the F.I.R., the petitioner did not complete the construction work of the school, although, he had taken the entire amount.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
