JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 21-12-2018 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the respondents. Learned counsel for the respondents, with reference to Annexure-B to the counter affidavit, submits that the agency has replied the Controller of Examination, Bihar School Examination Board that on verification of the master data, it was found that candidate, namely, Kanaklata Roll No. 1005110002 has filled up subject Hindi in OMR answer sheet in Paper I and not Social Science.
Learned counsel for the petitioner submits that the reply has been received in December, 2018 with regard to the examination of 2011.
In view of the above, the Court is not in a position to
Patna High Court CWJC No.7218 of 2015(3) dt.21-12-2018 2/2 decide the disputed question of fact.
Learned counsel for the petitioner submits that the respondents may be cautioned that in future they may not commit such mistake which cause prejudice to the innocent examinees.
If the respondents have evaluated the OMR sheet negligently, they are cautioned that in future if they are found negligent in the matter of evaluation, they may be saddled with heavy cost.
With the aforesaid, the writ petition stands disposed of.
