JUSTICE BIRENDRA KUMAR ORAL ORDER 14-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in connection with Kathaiya P.S. Case No. 41 of 2017 for the offences punishable under Sections 272 and 273 of the Indian Penal Code and under Sections 47, 30, 35 and 53 (c) of Bihar Prohibition and Excise Act, 2016.

The accusation of informant against the petitioner, that the petitioner is involved in illegal business of liquor, is based on the information of the spy.

Submission of the learned counsel for the petitioner is that only on the basis of suspicion the petitioner was made accused. He further submits that the petitioner has no criminal

Let, the petitioner, above named, in the event of his arrest or surrender the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned concerned Court below/Successor Court in connection with Kathaiya P.S. Case No. 41 of 2017 subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. With further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
