Petitioner seeks bail in Rautara P.S. Case No.42 of 2019 instituted for the offence under Section(s) 366-A, 323, 504/34 Indian Penal Code and Section 3(1)(r)(S) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

Counsel for the petitioner submits that informant has alleged that his daughter had gone to cut grass, but she did not return. He learnt during search that this petitioner and other accused persons has kidnapped his daughter.

The victim on her recovery has given statement under Section 164 Cr.P.C., wherein, she has stated that she had gone with Mufaiz. She has not taken name of this petitioner.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar, in connection with Rautara P.S. Case No.42 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
