JUSTICE ARUN KUMAR ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Sections 147, 148, 149, 341, 323, 324, 307, 153, 153A, 295, 295A, 337, 338, 353, 332, 435, 379, 427 and 120(B) of the Indian Penal Code.

Allegation in brief is that the procession was proceeding on the occasion of Ramnavmi and members of other community made protest against passing the Ramnavmi procession through that route and pelted stones, brick bats and when police tried to control the situation, they tried to snatch their arms. Some injuries were caused to police personnel and set ablaze some vehicles.

It is submitted that there is no specific allegation

Patna High Court Cr.Misc. No.30117 of 2017 (2) dt.06-07-2017 2/2 against the petitioner. Without any material, he has been implicated and his name appears in the F.I.R. at sl.no.43 moreover he has got no criminal antecedent.

Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Safdar Khan be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Bikramganj, District- Rohtas in connection with Bikramganj P.S. Case No.86 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Arun Kumar, J) N.H./- U T
