JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 19-08-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioner apprehends her arrest in connection with Agiaon Bazar P.S. Case No. 61 of 2016 for the offences punishable under sections 304 (B) and 201/34 of the I.P.C.
Minu Kumari, the sister of the informant, was married to Tinkal Singh, the son of the petitioner, on 13.07.2016 and the petitioner, father-in-law and the husband used to demand gold chain and motorcycle. On 18.10.2016 it was informed that Minu Kumari died and before arrival of the informant the dead body was cremated. The father-in-law of the deceased informed that due to the electric shock his sister died, but it is learnt that she has been killed due to non fulfillment of demand of dowry.
Patna High Court Cr.Misc. No.30857 of 2017 (3) dt.19-08-2017 2/2 Submission is of false implication and that the petitioner is an old lady aged about 62 years, the deceased died due to the electric shock and the informant was present at the time of her cremation but after one day he lodged this false case as his illegal demand was not fulfilled, the allegation of demand of dowry is false and concocted, nobody has ever demanded anything from the sister of the informant, during investigation the independent witnesses, namely, Godhan Singh and Sanjit Singh, vide paragraphs- 26 and 27 of the case diary, have stated that the deceased died due to the electric current and the informant lodged this case.
The learned A.P.P. submits that other prosecution witnesses have supported the occurrence.
In the facts and circumstances as stated above, the petitioner, in case of her arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. A.C.J.M-8, Bhojpur at Ara in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
