The petitioner seeks bail in Chakand P. S. Case No. 150 of 2018 instituted for the offence under Section(s) 323, 341, 307, 379, 504, 506/34 and 302 of the Indian Penal Code. In the written report informant has alleged that this petitioner caught hold informant and co-accused Golu Kumar assaulted him by means of danda on his head, on account of which he sustained injury. Subsequently, the informant died. The Sessions has mentioned in the impugned order that postmortem report is available at paragraph no. 56 of the case diary and opinion regarding cause of death has been kept reserved till receipt of the chemical report. Patna High Court CR. MISC. No.42916 of 2019(2) dt.17-07-2019 2/2 against co-accused Golu Kumar. Fardbeyan was given by informant himself before the police in the IGIMS. Petitioner is in custody since 24.11.2018 having no criminal antecedent.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-VI, Gaya in connection with Chakand P. S. Case No. 150 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
