JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-02-2015 Petitioner is languishing in custody since 13.04.2014 in a case registered for the offences punishable under Sections 365, 367/34 of the I.P.C.

It is alleged that petitioner and others instigated the son of the informant to go to Pune to get proper employment, as a result the son of the informant went to Pune on 20.05.2010 and thereafter he went traceless. It is submitted by learned counsel for the petitioner that First Information Report has been lodged after about more than two years of the date when the informant's son left for Pune. During investigation it has come that after reaching to Pune the son of the informant talked with the informant for a week and thereafter he did not talk. Subsequently the informant has retracted from the initial version.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Chapra in connection with Trial No. 4124 of 2014, arising out of Manjhi P.S.
