JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-09-2019 The petitioner seeks bail in connection with Dinara P.S. Case No. 98 of 2019, dated 06.04.2019, instituted for the offences under Sections 341, 323, 354 and 307/34 of the Indian Penal Code and Sections 25(1-b)a, 26, 27 and 35 of the Arms Act.

The petitioner and four others are said to have fired from their weapon which was a celebratory firing. It has been alleged that the petitioner and others wanted the singer on the stage to sing a song of their choice and when this request was not acceded to, the petitioner and others

Mr. A.B. Ojha, learned Senior Advocate appearing for the petitioner submits that because of the petitioner hailing from minority community, he has been made accused in this case by the villagers and the weapon which is said to have been recovered from the possession of the petitioner was planted on his person.

The petitioner is in custody since 07.04.2019. Considering the nature of accusation against the petitioner/Mohd. Ahmad Alam @ Modi, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Bikramganj, Rohtas, in connection with Dinara P.S. Case No. 98 of 2019. The application stands allowed.
