The petitioner apprehends his arrest in Chandradeep P.S. Case No. 84 of 2019, registered for the offences punishable under Section 302 and other allied sections of the Indian Penal Code.
Prosecution case in brief is that son of informant was called by one Chandu Paswan to Aliganj Chowk. When his son reached there, someone fired which hit another man. All the persons started running away. Informant's son went inside the house of one Gyan Saw where 15 to 20 people were waiting for him and assaulted him due to which informant's son died. It is submitted that petitioner is not named in the FIR. Name of petitioner transpired during course of investigation
Patna High Court CR. MISC. No.55667 of 2021(2) dt.28-06-2022 2/2 only on suspicion. No specific overt act has been alleged against this petitioner. Petitioner is only alleged to be member of the mob.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist Class, Jamui in connection with Chandradeep P.S. Case No. 84 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
