The petitioner apprehends his arrest in Marhowrah P.S. Case No.804 of 2019, registered for the offences punishable under Sections 30 and 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. There is no recovery from the conscious possession of the petitioner rather 5 litres of country made liquor is said to have been recovered from the house of the petitioner. It is submitted that petitioner has got clean antecedent as stated in para 3 of the bail application.

Patna High Court CR. MISC. No.55624 of 2021(2) dt.04-03-2022 2/2 Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Considering the fact that five litres of country made liquor is recovered from the house of the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
