Petitioner seeks bail in Turkauliya P.S. Case No.729 of 2018 instituted for the offence under Section(s) 302 and other allied sections of Indian Penal Code.
Counsel for the petitioner submits that other accused have already been granted bail by this Court by order dated 10.05.2019 passed in Cr. Misc. No.31059 of 2019. In the written report, it is alleged that petitioner and other accused persons armed with weapons caught hold son of the informant. Co-accused, Jitndra Rai, assaulted son of the informant in his chest with Gupti. Accused Gabbar Rai gave dagger blow in his abdomen and Dilip Rai also assaulted by
Patna High Court CR. MISC. No.42805 of 2019(4) dt.02-09-2019 2/2 means of knife. Son of the informant fell down and subsequently died.
There is no allegation of any assault against the petitioner.
Petitioner is in custody since 14.02.2019.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran, in connection with Turkauliya P.S. Case No.729 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner. (Sanjay Priya, J) J. Alam/- U T
