JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 14-06-2017 Heard learned counsel for the petitioners as well as learned APP for the State.

The petitioners apprehend their arrest in Forest Case No. 25F of 2016 registered for the offences under Sections 2, 27, 29 and 31 of the Wild Life Animal Protection Act. As per the prosecution case, six sisham logs were seized from the tractor-trailer of Sk. Bullet. It is submitted by learned counsel for the petitioners that the petitioners are not named in the F.I.R. They have committed no offence and have been falsely implicated in the case. They have no concern with the aforesaid occurrence. Their

Patna High Court Cr.Misc. No.18299 of 2017 (3) dt.14-06-2017 2/2 names came in the light only on the basis of the confessional statement of the co-accused Sk. Bullet which was recorded on third occasion by the forest department.

Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in Forest Case No. 25F of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
