A coordinate bench of this court has occasioned to decide the issue in C.W.J.C. No. 6139 of 2007 and the decision of the writ court was affirmed by the LPA court in LPA No. 756 of 2015.
In view of the above, the writ petition is disposed of with direction to the respondents to consider the case of the petitioners in the light of the decision in C.W.J.C. No. 6139 of 2007 and LPA No. 756 of 2015 dated 16.8.2017 within a maximum period of sixty days from the date of receipt/production of a copy of this order and if it is found that the case of the petitioners is similar to the petitioners in C.W.J.C. No. 6139 of 2007, similar benefit should be extended to the petitioner within the time frame indicated hereinabove. With the aforesaid, the writ petition stands disposed of.
