JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 14-06-2017 Heard learned counsel for the petitioner as well as learned APP for the State.
The petitioner apprehends his arrest in Barhara P. S. Case No. 347 of 2016 registered for the offences under Sections 341, 323, 324, 307, 504 and 34 of the Indian Penal Code. The petitioner has been indicted with assaulting the informant and his nephew by means of dagger.
It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and he has committed no offence. He has been falsely implicated in the case. The injury sustained by the victims is simple in nature. There is a case and counter case between the parties.
Considering the facts aforesaid and the nature of
Patna High Court Cr.Misc. No.18324 of 2017 (2) dt.14-06-2017 2/2 allegation made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara in Barhara (Krishnagarh) P. S. Case No. 347 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
