The petitioner apprehends her arrest in Magadh Medical P.S. case No. 44 of 2019 registered under Section 30(a) (d) of the Bihar Prohibition & Excise Act.

The police on secret information about selling of liquor raided the house of the petitioner and recovered five liters of country made liquor. The recovery was also made from the house of other persons.

The learned counsel for the petitioner submits that similarly situated accused Bauna Manjhi and Pramod Manjhi have already been granted anticipatory bail but since recovery is made from the house of petitioner and in view of the provision as contained in Section 76(2) of the Bihar Prohibition & Excise Act, I am not persuaded to grant anticipatory bail to the petitioner.
