Petitioner seeks bail in a case registered for the offences punishable under Sections 307,120(B) and 34 of the Indian Penal Code and Section 27 of the Arms Act but later on Section 302 of I.P.C. was added.

Petitioner is in custody since 14.08.2017. Petitioner is one of the assailants of the deceased as per dying declaration of the deceased made before the father of the deceased who is informant of this case.

Earlier prayer for bail was refused on 21.08.2018 with direction to the learned Trial Judge to conclude the trial preferably within nine months.

Patna High Court CR. MISC. No.43324 of 2019(3) dt.16-10-2019 2/2 The report of the learned Trial Judge reveals that the case is yet to be committed to the court of sessions. In the circumstance, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sultanganj Police Station Case No.167 of 2017, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
