2. In this case, the petitioner is seeking regular bail in connection with Excise Case No. 1456 of 2023 arising out of Excise P.S. FIR No. 546 of 2023, registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. As per allegation, on a secret information, the informant along with other police party reached the place of occurrence. Seeing the police party, the petitioner started fleeing away but was apprehended. On search, 10 liters of illicit country-made liquor was recovered from the bag of petitioner.

4. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.51512 of 2024(2) dt.30-07-2024 2/2 that the petitioner is innocent and has falsely been implicated in this case due to ulterior motive. Nothing has been recovered from his conscious possession and he is under custody since 30.12.2023.

5. Considering the above-mentioned facts and circumstances as well as the period of custody, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge (Excise Court01) POCSO, Hajipur, Vaishali in connection with Excise Case No. 1456 of 2023 arising out of Excise P.S. FIR No. 546 of 2023, subject to the following condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
