JUSTICE SUDHIR SINGH ORAL ORDER 01-07-2017 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are apprehending their arrest in a case registered under Sections 341, 149, 323, 324, 307 and 379 of the Indian Penal Code.

The prosecution case, in brief, is that on 6.5.2017 at 5 P.M. while the informant was going to purchase vegetables in Malkauli market, the accused persons including the petitioners came with deadly weapon and surrounded him due to previous land dispute and they assaulted him by means of farsa with intention to kill him.

It has been submitted on behalf of the petitioners that the petitioners No.1 and 3 have got no criminal antecedent. As far as petitioner No.2 is concerned, there is one other case pending

Patna High Court Cr.Misc. No.28436 of 2017 (2) dt.01-07-2017 2/2 against him. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. General and omnibus allegation has been made. No specific injury has been attributed against the petitioners. Injury on the son of petitioner No.1 has not been explained by the prosecution.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Bagaha in connection with Bagaha (Pathkhauli) P.S. case No.219 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
