The petitioner seeks bail in Dholbajja (Kadwa) P.S. Case No. 55 of 2018, instituted for the offence under Section(s) 399, 402 of Indian Penal Code, Sections 25(1-b)A, 26 and 35 of the Arms Act.

Counsel for the petitioner submits that petitioner was not apprehended on spot.

It is alleged that four persons as named in the written report have been apprehended on the spot. They disclosed the name of petitioner before the Police. Petitioner is in custody since 6.11.2018.

Keeping in view the period spent by the petitioner

Patna High Court CR. MISC. No.44302 of 2019(2) dt.22-07-2019 2/2 in custody, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri D.K. Yadav, learned Judicial Magistrate, 1st Class, Naugachia, in the district of Bhagalpur, in connection with Dholbajja (Kadwa) P.S. Case No. 55 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
