The petitioner seeks bail in a case registered for the offence punishable under Section 384 of the Indian Penal Code and under Section 7 (a) of the Prevention of Corruption Act. The prosecution case, in brief, is that a video was got viral on the social media that a police man was taking bribe from a vehicle owner. On the basis of the said viral video, an enquiry was conducted and the petitioner is said to have identified as the said person.

It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He is quite

On the date of occurrence, the petitioner was not on duty at the said place. There is no statement of the person/owner of the vehicle from whom the bribe was taken and how much amount has been taken by him. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. The petitioner has no criminal antecednet and has been languishing in custody since 22.09.2020.

Learned counsel for the Vigilance submits that the petitioner has been dismissed from the service. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I-cum-Special Judge Vigilance, Bhagalpur in connection with Special Vigilance Case No.16 of 2019, arising out of Kotwali (Tilkamanjhi) P.S. Case No.927 of 2019.
