2. The petitioner has preferred this application for grant of regular bail in connection with Madhepura P.S. Case No. 481 of 2025 dated 23.04.2025 registered for the offences punishable u/ss 317(4), 317(5), 338, 336(3), 340(2) read with section 3(5) of the Indian Penal Code and sections 8(c) and 21(a) of the NDPS Act.

3. As per the prosecution case, total 4.33 grams of smack like substance was recovered from the pocket of the petitioner. A mobile phone, Rs. 800/- and a motorcycle were also recovered.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.44290 of 2025(2) dt.06-08-2025 2/2 this case. The seized contraband is of small quantity. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 24.04.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the petitioner had no any valid authorization for keeping the said contraband material.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Madhepura in connection with Madhepura P.S. Case No. 481 of 2025.

7. The application stands allowed.
