JUSTICE BIRENDRA KUMAR ORAL ORDER 28-09-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 342, 302, 120B of the Indian Penal Code and Section 27 of the Arms Act.

The informant is not an eye-witness of the actual occurrence of murder. However, when he reached at the place of occurrence, hearing the sound of firing, he saw that co-accused Munna Yadav and Buban Yadav were carrying rifle and others were carrying small firearms. Petitioner is not named in the FIR. It appears that co-accused Lallu Yadav and Raju Yadav have already been allowed anticipatory bail by a Coordinate Bench of this Court vide order dated 18.09.2017 and

Patna High Court Cr.Misc. No.29492 of 2018 (7) dt.28-09-2018 2/2 13.12.2017 passed in Cr. Misc. No. 36232 of 2017 and Cr. Misc. No. 56011 of 2017.

Hence, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Tekari Police Station Case No. 344 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
