====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 16-07-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 25.02.2019 in a case for the offence registered under Section 392 of the IPC.

The prosecution story, in brief, is that the informant was returning to his house on a Motorcycle after collecting loan amount of Rs. 53,055/- from the women. In the meantime, two persons came on a Motorcycle behind the informant and slightly rubbed him as a result of which, he fell down on the Sand. Thereafter, two persons again came on a Motorcycle and on the point of arms, accused persons snatched the bag from the

When the informant went to complain at Barhariya Police Station where he was shown photo Album of accused persons. After seeing the photo album, the informant identified a person. The Chowkidar disclosed the name of the person as Raghbendra Singh (petitioner).

It has been submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. As per the F.I.R., the petitioner has been named in the present case on the basis of photo shown to the informant by the Chaukidar of the police station. There is no recovery of any incriminating article from possession of the petitioner. No formal T.I. Parade was conducted to ascertain the participation of the petitioner in the present case. On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M.
