JUSTICE MOHIT KUMAR SHAH ORAL ORDER 15-06-2017 Learned Advocate on Record seeks permission to make correction in typographical error, which has taken place in paragraph-3 of the application. He is permitted to do so, during the course of the day.

Heard the learned Senior counsel for the petitioner and the learned Additional P.P. for the State.

The petitioner seeks anticipatory bail in connection with Nathnagar P.S. Case No. 183 of 2016 dated 27.06.2016, registered for the offence punishable under Sections 489(A), 489(B), 489(C)/ 34 of the Indian Penal Code.

The allegation according to the informant is that one Pinki Devi (co-accused) was apprehended and three fake currency notes of Rs. 1000/- each were recovered from the place of occurrence and allegedly other accused persons including the

Patna High Court Cr.Misc. No.17149 of 2017 (3) dt.15-06-2017 2/2 petitioner, who were sitting in the same auto rickshaw, fled away. Learned senior counsel, appearing on behalf of the petitioner, submits that the petitioner is innocent, no recovery has been made from the possession of the petitioner and she is a mother of two children. It has also been submitted that the petitioner is accused in one another case, however, she has been granted bail in that case.

Having regard to the facts and circumstances of the case, I deem it fit and proper to grant anticipatory bail to the petitioner.

Accordingly, in the event of her arrest or surrender in the Court below within a period of four weeks from today, let the above named petitioner be enlarged on bail on furnishing bailbonds of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate- 1st, Bhagalpur in connection with Nathnagar P.S. Case No. 183 of 2016 dated 27.06.2016, subject to the conditions laid down under Section 438(2) Cr. P. C.
