JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-05-2015 The petitioner has renewed his prayer for bail in a case registered under Section 302/34 of the Indian Penal Code.

It is alleged that informant's brother was being assaulted by the accused persons including the petitioner when the father of the informant came to rescue he was assaulted by the accused persons. Subsequently the father of the informant succumbed to the injuries. The petitioner is alleged to have caused injury with brick to the victim. The report of learned Adhoc Additional Sessions Judge, 3rd, Khagaria dated 24.02.2015 suggests that out of nine chargesheeted witnesses only three witnesses are left to be examined including the I.O. and the doctor. The report of Superintendent of Police, Khagaria dated 09.04.2015 suggests that both the I.O and the doctor have already been examined.

Patna High Court Cr.Misc. No.30781 of 2014 (5) dt.06-05-2015 2/2 Considering the present stage of the trial, this Court is not inclined to interfere.

It is expected from the trial Court to conclude the trial expeditiously.

Accordingly the application is disposed of in connection with Gogri P.S. Case No. 145 of 2012, Sessions Trial No. 95 of 2013.
