This is an application for grant of anticipatory bail in connection with Pakridayal PS case no. 97 of 2016 registered for the offences punishable under Sections 307, 302, 120B/34 of Indian Penal Code and Section 27 of Arms Act. The allegation leveled against the petitioner is that while the informant was returning from Motihari to his village by Scorpio with his friends and cousins, the said vehicle was apprehended by motorcycle born accused persons near village Pakridayal. The said accused persons are said to have fired by pistol resulting in some of the persons sitting in Scorpio vehicle

Learned counsel for the petitioner submits that the petitioner is innocent and this Hon'ble Court, vide order dated 22.12.2016, 08.02.2017 and 09.02.2017 passed in Cr.Misc. no. 42764 of 2016, Cr.Misc. no. 52197 of 2016 and Cr.Misc. no. 1160 of 2017 respectively have also granted anticipatory bail to the co-accused persons.

Having regard to the facts and circumstances of the case, more particularly, the parity of the case of the petitioner with those of aforesaid co-accused persons, who have been granted bail by this Hon'ble Court, I deem it fit and appropriate to enlarge the abovenamed petitioner on anticipatory bail on furnishing bonds of Rs. 20,000/- (Rs. Twenty thousand) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate-V, Motihari (East Champaran) in Pakridayal PS case no. 97 of 2016 subject to the conditions enumerated under Section 438(2) of Code of Criminal Procedure.
