BAJANTHRI) 23-06-2022 Matter called twice. None appears for the petitioners. The petitioners have assailed the order dated 16.1.2018 passed in O.A. No. 050/00468/2014 by the Central Administrative Tribunal, Patna Bench, Patna.

The grievance of the respondents is to extend the benefit of grade pay of Rs. 2400. The Tribunal after due examination of the records proceeded to allow the original application with a rider that respondents are entitled to grade

Patna High Court CWJC No.10465 of 2018(6) dt.23-06-2022 2/2 pay of Rs. 2400/- on par with the other Laboratory Assistants of the applicants in O.A. No. 3592 of 2012. Such grant of benefit to the respondents is subject to outcome of the decision which is stated to be pending consideration before the Hon'ble High Court, Delhi.

In the light of these facts and circumstances, we find no interference is called for in respect of order dated 16.1.2018 passed in O.A. No. 050/00468/2014. Accordingly, this petition stands dismissed, reserving liberty to the petitioners to revive this petition in the event of favourable order is passed in favour of department by the Hon'ble High Court of Delhi.
