The petitioner has prayed for grant of regular bail in connection with Purshottampur P.S. Case no. 44 of 2020 registered under sections 307, 341, 323, 324, 379, 354B, 504, 506 and 34 of the Indian Penal Code.

As per allegation in the FIR, over a dispute relating to flow of water, it is stated by the informant that the the petitioner herein assaulted Samim Alam by khanti.

It is submitted by learned counsel for the petitioner that the allegations as narrated in the FIR are false and incorrect. No such occurrence as narrated in the FIR has taken place. There is case and counter case between the parties. No injury

Patna High Court CR. MISC. No.41037 of 2020(3) dt.17-03-2021 2/2 report of Samim Alam is available in the case diary. The petitioner is in custody since 9.6.2020 and has no criminal antecedent.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner together with the period in custody, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Purushottampur P.S. Case no. 44 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Bettiah, West Champaran.
