Petitioner has prayed for following reliefs:-

Patna High Court CWJC No.17164 of 2021 dt.22-01-2022 2/3 It has been submitted by learned Sr. counsel for the petitioner that application of the petitioner for appointment of PDS dealer on the basis of compassionate ground is pending before the Sub-Divisional Officer since the year 2019 and no decision has been taken up by the Sub-Divisional Officer-cumLicensing Authority and neither his case has been put up before

Patna High Court CWJC No.17164 of 2021 dt.22-01-2022 3/3 the District Level Selection Committee for his appointment as PDS dealer on compassionate ground under Clause 10 of Bihar Targated Distribution System Control Order, 2016. Writ petition is disposed of with a direction to the District Level Selection Committee under the Chairmanship of District Magistrate to consider the application filed by the petitioner for his appointment as a PDS dealer on compassionate ground.

It is made clear that this Court has not expressed any opinion on the merit of the claim of petitioner and same is to be considered and decided by the Selection Committee on its own merit within three months from the date of receipt/production of a copy of order passed by this Court.

With aforesaid observations and direction, this writ petition stands disposed of.
